There are several drugs that are available in the market. People buy the drugs on the basis of the trust that they have on the company manufacturing the drugs. Therefore it is the duty and responsibility of the drug manufacturers and selling companies to make the consumers aware of the side effects and other harms of the drugs. It becomes the responsibility of the company to tell the people about the harmful effects along with the benefits of the drugs. If the responsibility of telling so is not fulfilled by the company, the company becomes liable under the law. There have been several such incidents so far. One of these incidents that came into news is the Yaz recall incident.
Yaz recall was an incident that came in light in the year 2009. The history of the Yaz recall incident started in the year 2008. In2008, there were a series of commercials broadcasted on the television which overstated the use of the Yaz drugs without informing the people about the side effects and harmful effects of the usage of the drugs. This Yaz recall incident was brought to light by Jim Edwards who posted the same in the pharma industry blog post on the website bnet.com. The whole Yaz recall incident was already known to the Food and Drugs Administration department but was kept buried under the Food and Drugs Administration report. There were problems with the manufacturing processes of the Yaz which produced poor quality birth control pills. Because of this there were several victims who suffered because of the poor quality birth control pills. There was a warning letter issued to the company by the FDA to Bayer which did not disclose all the facts including the harmful effects to the public. There were 129 lawsuits brought against Bayer till October 8th 2009. There were several grounds for bringing the lawsuits against the Bayer. The first was to overstate the use of the drugs and promoting that it was a safe drug without telling the harmful effects. The second was that for the improper research of the medication. Another ground was that even after the post marketing reports, the drugs were not recalled.
Finally in November 2009, the drugs were recalled which is known as the Yaz recall. There were nearly 33,000 boxes that were recalled in the Yaz recall incident. The grounds that were put in defense by the company in the Yaz recall incident were that the company checked the drugs on average basis and not each batch separately.
